By accessing, browsing, registering, listing, booking, renting, or otherwise using the Platform available at www.rentedghar.com, you agree to be legally bound by these Terms and Conditions. If you do not agree to these Terms, please discontinue use of the Platform immediately.

RentedGhar is an online technology marketplace that enables users to:

Discover and book vacation homes, apartments, villas, rooms, and other accommodations.
Reserve tables at restaurants and dining establishments.
Rent products, furniture, appliances, equipment, vehicles, and other items listed by independent owners.
List properties and products for rent.
Facilitate communication and transactions between Hosts and Users.

RentedGhar acts solely as an intermediary technology platform and does not own, operate, manage, control, inspect, endorse, or guarantee any property, product, restaurant, service provider, host, renter, or guest listed on the Platform.

3. USER ELIGIBILITY

To use the Platform, you must:

Be at least 18 years of age.
Possess the legal capacity to enter into binding agreements.
Provide accurate, complete, and current information.
Maintain the confidentiality of your account credentials.

The Company reserves the right to suspend or terminate any account found to contain false, misleading, incomplete, or fraudulent information.

4. USER ACCOUNTS

Users are solely responsible for:

Maintaining account security.
Activities conducted through their account.
Updating profile information.
Preventing unauthorized access.

RentedGhar shall not be liable for losses arising from unauthorized account use.

5. HOST RESPONSIBILITIES

Hosts listing properties, accommodations, products, equipment, furniture, vehicles, or any rentable item agree that:

They possess lawful ownership or authorization to list such property or item.
All information, images, pricing, descriptions, amenities, specifications, and availability details are accurate.
Their listings comply with applicable laws, regulations, society rules, licenses, and permissions.
They are solely responsible for maintenance, cleanliness, safety, and functionality of listed properties or products.
They shall honor confirmed bookings unless cancellation is permitted under applicable policies.

Hosts are solely liable for any claims, disputes, damages, losses, injuries, accidents, or legal issues arising from their listings.

6. GUEST AND RENTER RESPONSIBILITIES

Guests and Renters agree that they shall:

Use booked properties and rented products responsibly.
Follow all host instructions and applicable laws.
Avoid unlawful, disruptive, dangerous, or fraudulent conduct.
Return rented products in substantially the same condition as received, subject to normal wear and tear.
Compensate hosts for any damage caused by negligence, misuse, or intentional misconduct.

Users shall remain fully responsible for their actions during the rental period.

7. PROPERTY BOOKINGS

Property listings are provided by independent hosts. RentedGhar does not guarantee:

Accuracy of property descriptions.
Suitability of accommodations.
Availability of amenities.
Property condition.
Safety standards.
Service quality.

Guests are encouraged to independently verify property details before booking. Any dispute relating to accommodation quality, amenities, cleanliness, maintenance, accessibility, neighborhood conditions, or host conduct shall be resolved directly between the Host and Guest.

8. PRODUCT RENTAL SERVICES

The Platform may facilitate rental of products including furniture, electronics, appliances, equipment, vehicles, and other rentable items. Product Owners are solely responsible for:

Ownership verification.
Product quality.
Product safety.
Product condition.
Product maintenance.
Compliance with applicable laws.

RentedGhar does not inspect, certify, warranty, or guarantee any rented product. The Company shall not be liable for:

Product defects.
Mechanical failures.
Product misuse.
Product damage.
Personal injury.
Property damage.
Delayed delivery.
Product unavailability.

9. TABLE BOOKINGS AND DINING RESERVATIONS

The Platform may facilitate restaurant table reservations. Restaurants remain solely responsible for:

Reservation acceptance.
Food quality.
Service quality.
Pricing.
Availability.
Customer experience.

RentedGhar shall not be responsible for restaurant operations, cancellations, delays, service deficiencies, food quality issues, or disputes between diners and restaurants.

10. PAYMENTS

Payments made through the Platform may be processed by authorized third-party payment gateways. By making a payment, users agree that:

Applicable taxes, convenience fees, platform fees, and service charges may be charged.
Payment gateway terms and conditions shall apply.
Transaction failures caused by banks, payment gateways, network issues, or technical interruptions are outside the Company's control.

RentedGhar reserves the right to withhold, release, adjust, reverse, or refund payments where required to prevent fraud, comply with legal obligations, or resolve disputes.

11. CANCELLATION POLICY

Cancellation policies may vary depending on the listing, property, product, restaurant, host, or service provider. Where no specific cancellation policy is displayed:

More than 7 days before booking start date: Up to 90% refund.
Between 3 and 7 days before booking start date: Up to 50% refund.
Within 72 hours of booking start date: No refund.

Convenience fees, gateway charges, taxes, and non-refundable fees may be deducted.

12. REFUND POLICY

Approved refunds shall generally be processed within 7 to 15 business days. Refund timelines may vary depending on:

Payment method.
Banking channels.
Payment gateway processing.

The Company does not guarantee exact refund processing times once a refund has been initiated.

13. PROHIBITED ACTIVITIES

Users shall not:

Violate any law.
Engage in fraudulent activities.
Provide false information.
Circumvent Platform payments.
Harass, threaten, or abuse other users.
Upload misleading content.
Infringe intellectual property rights.
Attempt unauthorized access to systems.

Violation may result in suspension, termination, legal action, and reporting to authorities.

Availability.
Security.
Continuous operation.

All use of the Platform is at the user's sole risk.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, KOLAHAL HOMES PRIVATE LIMITED, its directors, officers, employees, affiliates, agents, and partners shall not be liable for:

Property disputes.
Rental disputes.
Product defects or failures.
Property damage or theft.
Injury or death.
Loss of income or business.
Data loss or service interruptions.
Third-party misconduct, Host actions, or Guest actions.
Restaurant-related or Delivery-related issues.

RentedGhar functions solely as a marketplace facilitator and bears no responsibility for transactions conducted between independent parties.

16. INDEMNIFICATION

Users agree to defend, indemnify, and hold harmless KOLAHAL HOMES PRIVATE LIMITED and its affiliates from any claims, liabilities, damages, losses, costs, legal fees, or expenses arising from:

Use of the Platform.
Breach of these Terms.
Violation of applicable laws.
Disputes with other users.
Damage caused to persons or property.

17. INTELLECTUAL PROPERTY

All trademarks, logos, software, content, graphics, designs, text, and intellectual property displayed on the Platform remain the exclusive property of KOLAHAL HOMES PRIVATE LIMITED unless otherwise stated. Unauthorized use is prohibited.

18. TERMINATION

The Company may suspend, restrict, or terminate user access at any time without prior notice where:

Fraud is suspected.
Laws are violated.
These Terms are breached.
Platform security is compromised.

19. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of India. Any disputes shall be subject exclusively to the courts located in Lucknow, Uttar Pradesh.
